WOOLAVINGTON
FILE - Three copies of a case in a common pleas suit, Christopher Bethell v.
William Ashburnham, Bishop of Chichester and Charlotte Bettesworth, concerning
the ownership of the advowson of Woolavington. - ref.
LAVINGTON/790-792 -
date: 1774
|_ [from Scope and Content] The plaintiff, Bethell, claimed that he was patron
of Woolavington as devisee in trust of Slingsby Bethell who bought the advowson
from Anthony Nott who had bought it from Garton Orme (see no. 785). The second
defendant, Charlotte Bettesworth, argued that the advowsons were appurtenant to
the respective manors and although not specifically mentioned in any of the
settlements, or in the Act of 24 [recte 23] Geo. II., therefore passed under the
general words of rights, members and appurtenances, and that the mortgage
created in 1719 (see no. 783) was discharged among the other debts of the said
Garton Orme. 'About 4 or 5 years ago the living of Graffham became vacant Miss
Bettesworth presented a person who was regularly instituted but Mr. Bethell then
sued out a Quare impedit & got time to declare from Term to Term but never
declared & dropt all proceedings'. The livings of Woolavington and East Dean
being now vacant, Miss Bettesworth has presented the Rev. Thomas Collins to
Woolavington and the Duke of Richmond (who bought the Manor of East Dean from
Sir Matthew Featherstone) has presented the Rev. [Moses] Toghill. Mr. Bethell
has also presented to Woolavington, but the Bishop refuses institution to either
party till the matter is determined.
