This is the last Will and Testament of me Emma Fetherstonhaugh of No 14 Warwick Square in the parish of St George’s in the County of Middlesex, Widow. I give and bequeath to my Goddaughter Emma Heylin all my wearing apparel and the contents of my stork(?) table usually kept in my dining room and also my rosewood writing desk and its contents. I give and bequeath to my Godson Henry Heylin my mahogany writing desk and all its contents. I give and bequeath to the said Emma Heylin and Henry Heylin equally all my plated articles, cutlery, earthernware, china, glass and all other my household effect on the basement of my said house No 14 Warwick Square aforesaid. And also all my blankets and counterpanes and all my linen marked Fetherstonhaugh. I give and bequeath to James Whishaw of No 32 Harewood Square in the said County of Middlesex, Esquire all the Wines and Spirituous liquors which shall be in the Wine Cellar of my said house no 14 Warwick Square aforesaid absolutely. I give and bequeath the following pecuniary legacies namely the sum of One hundred pounds to my brother Henry Kimber. The sum of Two hundred pounds to my nephew Thomas Allrin Saunders. The sum of One hundred pounds to my friend Mrs Whishaw, the Wife of the said James Whishaw for her separate use. The sum of Fifty pounds to each of my nieces, Emily Ellen and Adelaide, the daughters of my said brother, Henry Kimber for the separate use respectively. The sum of Fifty pounds each to Mary (known as Minnie) and Inez the daughters of the said Thomas Allrin Saunders for their separate use respectively. The sum of One hundred and twenty five pounds to the said Henry Heylin, the sum of One hundred and twenty five pounds to the said Emma Heylin for her separate use. The sum of Nineteen pounds and nineteen shillings to Mrs Woods of Malvern in the County of Worcester, Widow of William Woods late of High Street Worcester, Chemist. The sum of ten pounds to Harriet Rebecca Woods daughter of the late William Woods of Woodbridge in the County of Suffolk, Spinster, the sum of Nineteen pounds nineteen shillings to Caroline Trotman of Woodlands Dursley in the County of Gloucester, Spinster. The sum of Fifty pounds to my cook Ann Collyer, Spinster and the sum of Thirty pounds to my housemaid Emma Evans, Spinster. And I desire all the said legacies to be paid free of legacy duty. And whereas by a Codicil dated the fifth day of May One thousand eight hundred and seventy four to the Will of my late husband Alexander Stephenson Fetherstonhaugh, Esquire deceased, the sum of One thousand pounds is thereby bequeathed to such person or persons as I shall by my Will direct or appoint. Now I do hereby devise and bequeath and in exercise of the said power and of every other power of testamentary disposition appoint all my real and personal estate whatsoever and wheresoever (except what I have hereinbefore otherwise disposed of) and whether in possession or expectancy of, to or over which I shall have at my decease be devised professed or entitled or have any such power as aforesaid (including the said sum of One thousand pounds). Unto and to the use of the said James Whishaw his heirs, executors, administrators and assigns (according to the nature or quality thereof respectively). Upon trust to sell, call in and convert into money such portions of the same as may not consist of ready money with power to make any such sale either by public Auction or private Contract and subject to any ordinary or special conditions and generally in such manner in all respects as my said trustees shall think fit with power also to buy in any Auction and to vary and rescind on terms or gratuitously any Contract for sale and to resell without any liability for consequent loss and to execute and do all such assurances and things for carrying this trust into effect as he shall think fit and out of the net monies arising from such sale calling in and conversion and the ready money of which I shall be possessed at the time of my decease to pay and discharge my funeral and testamentary expenses and debts and the said legacies hereinbefore given and to invest the residue of such monies in his name in or upon any British Colonial or Foreign Government, parliamentary or other stocks, funds, shares or securities or on the security of any freehold, Copyhold or leasehold estates in England, Wales or Ireland or any chattels, real or personal and from time to time to vary such investments into or for others of the like nature and to stand possessed of the said trust monies and the investments thereof upon trust if he shall not have assigned, charged or incumbered the same or have effected so to do to pay the interest, dividends and annual income thereof to the said Thomas Allrin Saunders during his life or until he shall assign charge or incumber the same or affect so to do, or be, or become a bankrupt or liquidate his affairs or compound with his Creditors and after the failure or determination of the said trust in favour of the said Thomas Allrin Saunders shall pay or transfer the said trust moneys and the investments thereof and the interest dividends and income thereof unto and equally between and among the said Mary (known as Minnie ) Saunders and Inez Saunders the said two daughters of the said Thomas Allrin Saunders for their separate use respectively as tenants in common. And I devise and bequeath all estates vested in me as a Trustee or Mortgagee unto the said James Whishaw his heirs, executors, administrators and assigns upon the trusts and subject to the equities affecting the same, but the money secured by any Mortgage shall form part of my residuary estate. And I appoint the said James Whishaw Executor and Trustee of this my Will. And I revoke all former Wills, Codicils and testamentary dispositions whatsoever. On the 9th January 1880 Admon with the Will annexed of the personal estate of Emma Fetherstonhaugh late of No 14 Warwick Square in the parish of St George in the County of Middlesex, Widow who died 15 August 1879 at No 14 Warwick Square aforesaid was granted to Adelaide Kimber, Spinster (daughter of Testatrix’s brother Henry Kimber) a legatee she having been first sworn. James Whishaw, the sole Executor and Residuary Legatee in trust having renounced Thomas Allrin Saunders the Nephew, the Residuary Legatee for life in the said Will mentioned, having on his own behalf and as the natural and lawful father, next of kin and the Curator or Guardian duly elected by Mary Saunders and Inez Saunders, Spinsters, Minors the Residuary Legatees substituted in the said Will having renounced the Letters of Administration (with the said Will annexed/of the said personal estate).-
