I William Fetherston of Hamilton a place St Johns Wood in the county of Middlesex Esquire being of sound mind memory and understanding do make this my last will and testament as follows First I direct my executors hereinafter named as soon as conveniently may be after my decease to make sale dispose or call in and convert into money all such parts of my personal estate as shall be outstanding and as shall not consist of ready money or monies in the Government stocks or funds of Great Britain [except my leasehold properties and my shares in the Kennett and Avon Canal and in the City of London Auction Mart? hereinafter specifically bequeathed and I direct my executors to stand possessed of such ready money and of the proceeds of such sale and conversion as also of all my property in the Government stocks or funds of Great Britain [except the long? Annuities hereinafter specifically bequeathed ][and which Government Stocks and funds [except as aforesaid]I hereby direct shall be sold as occasion than required to answer the general purposes of this my will]upon trust in the first place to pay thereout all my just debts funeral and testamentary expenses and the expenses of proving this my will and subject thereto upon trust for the general purposes of this my will I give devise and bequeath all that my copyhold messuage tenement and premises now on lease to Mr Slivewick? Butcher and situate at Kentish Town in the said county of Middlesex Also all those my leasehold messuages and premises situate No 26 Green Street Grosvenor Square No57 Seymour Place Bryanston Square and No 31 Park Road opposite ----- Johns Wood Chapel St Marylebone all in the said county of Middlesex with all rights members hereditaments and appurtenances to the said copyhold and leasehold messuages and dwelling houses respectively belonging or appertaining Also the sum of fifty eight pounds per annum lower annuities now standing in my name in the Books of the Govance? And Company of the Bank of England unto my brother in law James Easton of Hamilton Place St Johns Wood aforesaid Gentleman and my cousin William Hale of Highgate? Their heirs executors administrators and assigns according to the nature and quality of the same properties respectively and for all my estate tean? And interest estates teans? And interests therein respectively upon trusts and to and for the several and intents and purposes and under and subject to the several powers provisions declarations and agreements hereinafter limited declared expressed and contained of and concerning the same that is to say Upon law? That they my said trustees or the trustee or trustees for the time being acting under this my will do and shall as to the said copyhold and leasehold messuages dwelling houses and premises from time to time as occasion may require ----ise and leave all or any part or parts thereof with the appurtenances to any person or persons for any term or number of years not exceeding twenty one years to take effect in possession and not in a reversion there being reserved on every such demise or lease the best most improved yearly rent or rents that can or may be reasonably had or gotten for the same without taking any fine premium or foregift? For the granting thereof and there being contained in every such Indenture of demise or lease a condition for reatry? On nonpayment the rent or rents thereby reserved by the space of twenty one days after the same rents shall respectively become out and payable and the person or persons respectively to whom such demise and lease shall be made and executing counterparts thereof and thereby covenanting for the one payment of the rent or rents thereby to be reserved and upon this further trust that they my said trustees or other the trustee or trustees for the time being acting under this my will do and shall from time to time receive the rents of my said copyhold and lease hold messuages and tenements and also the said long annuities as and when the same shall respectively become due and payable and shall and will stand possessed thereof upon the trusts and for the purposes following that is to say upon trust that they my said trustees do and shall pay and discharge thereout in the first place all ground rent Insurance rates taxes repairs and all other necessary outgoings in relation or incident to the said copyhold and leasehold messuages and premises and subject thereto upon this further trust that they my said trustees do and shall pay thereout in the next place unto my female servant Charlotte Morris or unto such person or persons as she from time to time by any writing [------] her hand may appoint to receive the same an annuity or clear yearly sum of twenty five pounds for and during the term of her natural life free and clear of all legacy duty payable half yearly the first half yearly payment to begin? and be made at the expiration of six calender months from the day of my decease the said annuity to be for her own and separate use and benefit and her receipts alone or of such person or persons as she may in manner aforesaid appoint to receive the same to be sufficient discharged to my said trustees for the money which in such receipts shall be expressed to be received notwithstanding any husband with whom she may hereafter intermarry and in case the said Charlotte Morris shall happen to depart this life between any of the half yearly days of payment of the said annuity then it is my will and desire that her executors or administrators shall be paid such a proportionate part of the half yearly payment of the said annuity then coming due as shall have accrued up to the period of her decease and subject to the applications aforesaid upon this further trust that they my said trustees or other the trustees or trustee for the time being acting under this my will do and shall pay one forth part of the said rents and long annuities when and as the same long annuities and rents shall from time to time become due and be received unto my ------ Elizabeth Easton wife of my said brother in law James Easton for and during the term of her natural life for her separate use and benefit independent of her present or any future husband and free from his debts contract? And engagements and I do declare that the receipt and receipts alone of my said sister for such rents and annuities shall notwithstanding her coverture be a good and sufficient discharge and good and sufficient discharges to my said trustees for the same and from and after the decease of my said sister then upon trust to pay the said one forth part of the said rents and annuities subject as aforesaid unto my said brother in law the said James Easton for and during the term of his natural life for his absolute use and benefit and from and after his decease upon trust that they my said trustees do and shall stand seized and possessed of one moiety of one fourth part of the said copyhold and leasehold messuages hereditaments and premises and long annuities and of the rents and profits thereof subject as aforesaid] for the child if only one or if more than one then for the children of my niece Elizabeth Waters wife of William Waters of Grandford Street Marylebone by her present or any after taken husband begotten or to be begotten to be equally divided between them [if more than one] share and share alike as tenants in common and not as joint tenants to be vested interest in such of the same children as is all or shall be a son or sons when and as he or they shall respectively attain his or their age or respective ages of twenty one years or die under that age leaving lawful issue living at his or their death or respective deaths and in such of the same children as is are or shall be a daughter or daughters when and as she and they respectively shall attain the like age or be married which shall first happen and to be paid and transferred to them respectively as soon after the said ages or days shall be attained as conveniently may be and in case any one or more of the said children being a son or sons shall die under the age of twenty one years and without leaving any issue of his or their body or respective bodies lawfully begotten living at his or their death or respective deaths or being a daughter or daughters shall die under that age and also before she and they respectively shall have been married then upon trust for the survivor or other or if more than one the survivors or others of the same children equally to be divided between them share and share alike as tenants in common to be vested at the respective ages days and times hereinbefore appointed for the vesting of the original share or shares of the same child or children and as to the other moiety of the said one fourth part of the said copyhold and leasehold messuages hereditaments and premises and long annuities and of the rents and profits thereof subject as aforesaid Upon the same and the like trusts in every respect for the benefit of the child if only one or if more than one the children of my nephew Robert Sparrow begotten or to be begotten as are lastly hereinbefore declared expressed and contained of and concerning the other ----- devised and bequeathed to the children of my niece Elizabeth Waters or as near thereto as always stamed? will admit and upon this further ----- that they my said trustees do and shall pay out other one fourth part of the said rents and annuities subject as aforesaid unto my half brother Stephen H[k]irkinbottom of Highgate for and during the term of his natural life for his own absolute use and benefit and from and after his decease upon trust that they my said trustees or other the trustee or trustees for the time being acting under this my will do and shall stand seized and possessed of one other fourth part of the said copyhold and leasehold messuages hereditaments and premises and long annuities and of the rents and profits thereof subject as aforesaid upon the same and the life trusts for the benefit of the child or children of the said Stephen H[k]irkinbottom by his present or any future wife to be begotten as are hereinbefore declared and expressed of and concerning the first mentioned moiety of the first mentioned one fourth part of the said copyhold and leasehold messuage hereditaments and premises and long annuities hereinbefore devised and bequeathed to be for the benefit of the children of the said Elizabeth Waters or as near thereto as circumstances will admit and in case there shall be no child or children of the said Stephen H[k]irinbottom to take under this present devise and bequest Then upon this further trust that they my said trustees do and shall stand seized and possessed of one moiety of the said last mentioned one fourth part of the said copyhold and leasehold hereditaments and premises and long annuities and of the rents issues and profits thereof subject as aforesaid upon the same and the life trusts for the benefit of the child or children of my niece the said Elizabeth Waters and as to the other moiety thereof upon the same and the like trusts for the benefit of the child or children of my nephew the said Robert Sparrow as are hereinbefore declared expressed and referred to of and concerning the two moieties of the last mentioned one fourth part of the said copyhold and leasehold messuages hereditaments and premises and long annuities hereinbefore devised and bequeathed for the benefit of the same children of the said Elizabeth Waters and Robert Sparrow respectively and upon this further trust that my said trustees or other the trustees or executors for the time being of this my will do and shall pay one other one fourth part of the said rents and annuities subject as aforesaid unto my said niece Elizabeth Waters for and during the term of her natural life for her separate use and benefit independent of her present or any future husband and free from his debts control and engagements and I do hereby declare that her receipts alone notwithstanding coverture shall be --- and sufficient discharged to my said trustees for the same and from and after the decease of my said niece Elizabeth Waters Upon trust that they my said trustees do and shall stand seized and possessed of one other one fourth part of the said copyhold and leasehold hereditaments and premises and long annuities and of the rents issues and profits thereof subject as aforesaid upon the same and the life trusts in every respect for the benefit of her children as are hereinbefore declared of and ----------- the first mentioned moiety of the first mentioned one fourth part of the said copyhold and leasehold messuages hereditaments and premises and long annuities hereinbefore devised and bequeathed to or for the benefit of the same children And upon this further trust that they the said trustees or the trustee or trustees for the time being acting under this my will do and shall pay the other and remaining one fourth part of the said rents and annuities subject as aforesaid unto my nephew the said Robert Sparrow for and during the term of his natural life for his own absolute use and benefit and from and after his decease upon trust that they my said trustees do and shall stand seized and possessed of one other and the remaining one fourth part of the said copyhold and leasehold messuages hereditaments and premises and long annuities and of the rents issues and profits thereof subject aforesaid upon the same and the like trusts in every respect for the benefit of his children as are hereinbefore declared expressed or referred to of and concerning the second mentioned moiety of the said first mention a mea-- ------------------------------- one fourth part of the said copyhold and leasehold messuages hereditaments and premises and long annuities hereinbefore devised and bequeathed to or for the benefit of the same children of the said Robert Sparrow I give and bequeath unto my said Terrace Edgeware Road widow one hundred pounds sterling To my cousin Mrs William Hale of Highgate widow one hundred pounds sterling To William Hale of Kentish Town one hundred pounds sterling To Joseph Hale brother of the said William Hale one hundred pounds sterling To my housekeeper Miss? Handley one hundred and ten pounds sterling To the said William Hale ? of Southwood Lane Highgate one hundred pounds sterling if he acts as one of my trustees and executors To my sister in law Miss Alice Raine of Gainford in the county of Durham one hundred pounds sterling I give and bequeath unto my said trustees the sum of two hundred pounds sterling to be laid out in their names in the purchase of some or one of the public stocks or funds of Great Britain or upon real or long securities in England with power to vary the same for other securities of the like description as they my trustees shall in their discretion think fit and do and shall stand possessed of the said stocks and securities and the dividends and interest thereof In trust to be paid and applied by them to such person or persons for such purposes and generally in such manner as Mrs Catherine Williams wife of John Williams of Pond Street Hampstead shall notwithstanding her coverture by her last will and testament or by any codicil or codicils thereto or by any writing or writings under her hand from time to time direct or appoint and in default of such direction or appointment and subject thereto upon trust to pay and transfer the said stocks funds and securities and the interest and dividends thereof to the said Catherine Williams for her own sole and separate use and benefit independent of her present or any future husband and her receipts alone or of such person or persons as she may appoint to receive the same to be good and sufficient discharges to my said trustees for the monies which in such receipts shall be acknowledged to be received And I hereby direct that all the foregoing legacies shall be paid as soon as conveniently may be after my decease I give and bequeath to my said trustees all the shares which I hold or any entitled to in the Kennett and Avon Canal being nineteen? in number and my four shares in the City of London Auctions Mart Bartholomew Lane London Upon trust to pay the dividends and income? thereof to my said sister in law Miss Alice Raine for and during the term of her natural life for her own absolute use and benefit or otherwise to permit her to receive the same and from and after her decease upon this further trust that they my said trustees or other the trustees or trustee for the time being acting under this my will do and shall stand possessed of one half of the said shares in the said Kennett and Avon Canal and in the City of London Auction Mart Upon such and the same trusts in every respect for the benefit of the children of the said Elizabeth Waters as are hereinbefore declared and expressed of and concerning the first mentioned moiety of the first mentioned one fourth part of the said copyhold and leasehold messuages hereditaments and premises and long annuities hereinbefore devised and bequeathed for the benefit of the same children or as near thereto as circumstances will admit And do and shall stand possessed of the other and remaining half of the said shares upon such and the same trusts in every respect for the benefit of the children of the said Robert Sparrow as are hereinbefore declared expressed or referred to of and concerning the second mentioned moiety of the first mentioned one fourth part of the copyhold and leasehold messuages hereditaments and premises and long annuities hereinbefore devised and bequeathed for the benefit of the same children or as near thereto as circumstances will admit I give and bequeath unto the trustees for the time being of the Butchers charitable Institution the meetings of which are held at the ffree Masons Tavern Great Queen Street London the sum of one hundred pounds sterling to be applied to use? of the Building ffund of the said Institution for Building? Almshouses but exclusive of any trust for purchasing Land or any object upon which I cannot legally bequeath the same I give to the Westminster Hospital near St Margarets Church Westminster the sum of fifty pounds sterling and to the Western Dispensary Charles Street Westminster the sum of fifty pounds sterling for the respective general purposes of these Institutions And I direct that the three last mentioned legacies respectively shall be paid exclusively out of such part of my personal estate as is legally applicable to Charitable purposes and to the Treasurers of the said respective institutions or such other persons as the trustees or managers thereof respectively shall direct and that the respective receipts of such treasurers or other persons shall be effectual discharges to my said executors for the said respective legacies I give and bequeath to my Man servant John Woodward in reward for his long and faithful service two hundred and fifty pounds sterling also all that my leasehold Coachouse and stables situate in Hamilton Mews St Johns Wood Road aforesaid for all my estate term and interest therein for his own absolute use and benefit and I hereby direct that the four last mentioned legacies of one hundred pounds, fifty pounds ---- fifty pounds and two hundred and fifty pounds including the bequest of the said Coachouse and stables to the said John Woodward and the said legacies of one hundred pounds and one hundred pounds hereinbefore bequeathed to my said sister in law Miss Alice Raine and William Hale of Highgate shall be free of legacy duty to the legatees and be paid within six calender months after my decease It is my request that Miss Handley and my servants Charlotte Morris and John Woodward may be provided with proper and suitable mourning And I give to my ffriends Ms Ja--- Handley and Mr Richard Tucker? a Mourning ring each All the rest residue and remainder of my estate and effects of what nature or funds? soever and wheresoever situate not hereinbefore by me devised or bequeathed including herein any legacy or legacies devises or bequest contained in this my will which may hereinafter lapse or of effect by any event whatsoever I give devise and bequeath unto my said sister Elizabeth Easton my said half brother Stephen Hickinbottom my said niece Elizabeth Waters and my said nephew Robert Sparrow to be equally divided between them share and share alike as tenants in common and not as joint tenants and their respective heirs executors administrators and assigns according to the nature and quality[quantity] of the said estates respectively Provided always and I do hereby declare that all and every receipt and receipts which shall be given by the trustee or trustees for the time being under this my will for any money to be received by them or either of them under or by virtue of this my will or the trusts aforesaid shall be a good and effectual acquittance and discharge or good and effectual acquittances and discharged for so much and to receive and give discharges for the monies which shall appear to be the balance of the same amounts without any responsibility? by or on the part of the person or persons paying the same to see to the application thereof or be answerable or accountable for the misapplication of the same or any part thereof and lastly I do hereby nominate constitute and appoint the aforesaid James Easton and William Hale of Highgate joint executors of this my will hereby revoking all former wills or testamentary papers by me heretofore made and declared? this to be and contain my last will and testament In witness whereof I the above named William ffetherston have to this my said last will and testament contained in twelve sheets of write ? paper at the foot of each of the said sheets set my hand this twenty ninth day of August in the year of Our Lord one thousand eight hundred and forty three W Fetherston Signed and declared by the above named William Fetherston as and for his last will and testament in the presence of us together present at the same of each Signature and declaration and who in his presence and in the presence of each other have hereunto subscribed our names as witnesses E---- - Pudelscombe notr F------- --- Richd Mills clerk to My –uddlecombe
