This is the last Will and testament of me Thomas Js FetherstonH of Bracklin Barony of Delvin County Westmeath whereby I duly revoke all other wills and testaments by me at any time heretofore made and all and every part and parts thereof I desire to be buried privately [without any unnecessary expense that the executors? May ----- ---- may be such as a hearse or otherwise in the Church ----- of Kilthinne? upon the lands? of Bracklin where members of my family have been already interred I hereby appoint my nephews William Chapman of South Hill and Richard Fetherston of -------- Trustees and executors of this my will I hereby give devise and bequeath unto them and their heirs all the freehold personal and real property of all kind and wheresoever whereof I shall be in any way legally entitled nevertheless upon the trusts and to and for the uses intent and purpose hereinafter expressed of and considering the ------- that is to say with regard to all my property whatsoever upon trust that my executors and trustees Wm Chapman and Richard Fetherston h shall pay the just -----debts funeral and testamentary expenses and all and every expense to------shall be reasonably put to or incur by reason of the trusts of this my will ----this purpose the said exors and trustees shall if necessary dispose as to them seem most advisable and not by auction? If such may be avoided all my --------- sheep farm and young horses also hay and corn? I hereby make the same ----------a fund for the discharge of such claims Provided always that my son ------- Fetherston h shall have a preference to all others in case my son shall offer such ------ for said as shall appear fair and reasonable to my said Exs and trustees with regard to my household furniture books delph glass china linen wine and farming articles also----- my plate [at present in London I desire to be considered as far as possible-------- with Mansion House of Bracklyn to my successor? I will and bequeath to my wife ------Featherston if alive at my decease otherwise to Howard Fetherston my four wheel carriages and carriage horses if any also Diamonds I will and bequeath to my 2 wheel carriage to my daughter Emily if alive & unmarried at my decease otherwise to Frances Roson to -----I leave my riding horses if any Whereas I have lately purchased the fee simple and tenure? Of the lands of Bracklyn and Ballymophry in the Barony of Delvin and County of Westmeath I will and bequeath the sum of two hundred pounds sterling being part of the rent to be paid for said lands by my successor as appears from lease to my daughter Emily Fetherston h to be paid by half yearly payments every first day of May and November each and every year and to her heirs and assigns for ever but if Howard Fetherston or such ressor? Shall within twelve years after my decease be desirous to purchase the same from his sister or her heirs or assigns he shall be at full liberty to do so on payment to my daughter Emily Fetherstonh or her heirs the sum of five thousand pounds sterling being only a part of the sum of seven thousand pounds paid by me to the Honble Mr King Harman of Newcastle County Longford I wish my son not at anytime to be put to Law costs further than is absolutely required such as a cert? to be binding between both concerned which sum of five thousand pounds when paid frees the property for ever from the original purchase money of seven thousand pounds Whereas under my marriage settlemt made in the year 1816 there was settled ten thousand pounds Irish currency for younger children a part of said sum namely two thousand three hundred and seven pounds thirteen shillings & ten pence sterling was paid by me to my daughter poor Eleanor Vignoles at her marriage as appears from deed executed by Howard Fetherston in the year 1841 such sum advanced by me still remains due upon the property settled upon my son Howard Fetherston such sum advanced by me namely two thousand three hundred and seven pounds 13 shillings and ten pence I now will and bequeath to my daughter Eleanor Vignoles the interest of which sum to be paid to my daughter half yearly from the date of my decease by Howard Fetherston at the rate of five per cent or the principal £2307-13-10 to be as managed by my trustees as strikes them best for her advantage and if Eleanor Vignoles should die without children I then will and bequeath said sum to revert to my son Howard Fetherston or his heirs for ever there still appears upon the marriage of my daughter Kate Mary Arthur that I advanced the sum of thirteen hundred and seven pounds 13 shillings and ten pence sterling being part of said sum of ten thousand pounds Irish settled for younger children such sum I now will and bequeath to my daughter Kate Mary Arthur the interest to be 4 per ct paid half yearly by Howard Fetherston and the principal sum of £1307-13-10 to be settled by my trustees or exors as strikes them best for her advantage and if said Kate Mary Arthur should die without children the interest to be paid to her husband during his life and I then will and bequeath said sum of thirteen hundred &seven pounds 13 shillings and ten pence to revert to my son Howard Fetherston for ever and whereas it appears there was advanced the sum of two thousand three hundred and seven pounds thirteen shillings and ten pence sterling paid to my daughter Frances Rodon being part of the sum of ten thousand pounds Irish and still one by Howard Fetherston such sum I will and bequeath to my daughter Frances Rodon the interest of4per ct to be paid half yearly to her by my son Howard Fetherston the principal to be arranged by my exors or trustees as strikes them best for her advantage and if my daughter should die without children I then will and bequeath the interest to be paid to her husband and after his decease to revert to Howard Fetherston both principal and interest for ever Whereas there appears still due the sum of two thousand three hundred and seven pounds 13 shillings and ten pence sterling being part of the said sum of ten thousand pounds Irish due by my son Howard Fetherston to Emily Fetherston my daughter such sum not being advanced by me remains together with the other claims upon my sons property to be paid by Howard Fetherston my son to Emily Fetherston and her sisters making the entire sum eight thousand two hundred and thirty pounds fifteen shillings and four pence sterling there being one thousand pounds sterling paid off by my son reducing the original sum of ten thousand Irish to £8230-15-4I will and bequeath the lands of Derrymore and Brutinstown in the Barony of Harbill and County Westmeath purchased by me from the Crown also the leasehold of the Honstown? Lands in the Barony of Delvin all the quit? rents of Bracklin and Ballimaror purchased by me also some houses in Dublin all of which I leave for ever to my son Howard Fetherston and his heirs I have paid my daughter Eleanor Vignoles Kate Mary Arthur and Frances Rodon each one thousand pounds sterling and interest left them by the late Honble Mr Bn Howard of Dublin which sums were paid to me by the hands of Sir Rph Howard of Bushy I now will and bequeath one thousand pounds sterling including all interest left my daughter Emily Fetherston by the late Honble Bn Howard which sum is now included in her fortune and to be paid by my trustees & exors I further will and bequeath the sum of one thousand pounds sterling to be paid to my daughter Emily Fetherston I will and bequeath the sum of one thousand pounds sterling to my daughter Kate Mary Arthur the interest of which sum is to be paid to her ---- at 4 per ct half yearly until paid off by my exors or trustees I will and bequeath to my wife Eleanor Fetherston he sum of five hundred pounds to be paid one year after my decease or sooner if possible I will and bequeath to – Branigan my late steward the sum of fifty pounds to be paid within two years after my decease if he is still living upon my property after payment and arranges of my daughter Emilys fortune and all other bequests and debts that maybe due and partly stated on paper attached to this my will The remainder of all my property derived from lands now purchased or hereafter purchased as will appear from my title deeds and not mentioned or settled by my marriage settlements of 1816 my leasehold interest in the lands of Murklin County Westmeath my interest in 30 Upper Brook St Grosvenor Square London with its furniture if unsold at my decease ---- due money in the funds or at Bankers in Dublin or London money in house or otherwise in short both my freehold & all personal property that I may possess at my decease when all my debts both Emilys fortune and bequests are so arranged by my trustees or exors I will and bequeath the balance whatever it may be at my decease share and share alike to be equally divided between all my children who may be alive In case Emily my daughter should be married in my lifetime If I should give her any fortune it is clearly to be conceived that such sum is to be deducted from the fortune now left her by me to be paid at my decease Lastly my will and mind is and I do order and provide that if any person or persons to whom I have given or bequeathed any legacy or gifts or bequests shall by any means whatsoever impeach this my will bequeathed notwithstanding If such should occur I then give and bequeath such gifts or legacies as left to those persons who have disputed this will their shares or sums to be equally divided with my children who have acted? up to my wishes in this respect I hereby appoint the said exors & trustees Guardians of the fortune of my said daughter Emily Fetherston until married or attain the age of 25 years and humbly beg for their kind advice to guide her through life I beg and request my son will assist the trustees as far as he can It is my wish that Howard Fetherston should get every just accommodation and reasonable time to pay the debts due upon his property and the interest to be moderate to meet and go with the times and prices of farm produce

Administration of the goods and so forth with the last will and testament annexed of Thomas James Fetherstonhaugh late of Bracklyn in the County of Westmeath Esquire deceased [having and so forth] was granted by the Most Revd Father John George and so forth unto Howard Fetherstonhaugh of said place near Killinan Esquire the one natural and lawful son and one of the next of kin of said deceased and one of the principal and residuary legatees named in the said will and John Rodon of Murthertown Castletown Delvin in said County Esquire they being first sworn personally William Chapman and Richard Fetherstonhaugh Esqrs the executors having duly renamed? Executable? Lady Fetherstonhaugh the widow and relict and Eleanor Vignoles otherwise Fetherstonhaugh widow Frances Rodon otherwise Fetherstonhaugh [wife of the said John Rodon] Catherine Mary Arthur otherwise Fetherstonhaugh [wife of Thomas Arthur ]and Emily Fetherstonhaugh spinster and the said Howard Fetherstonhaugh the natural and lawful children and only next of kin of said deceased and the principal and residuary legatees named in the said will having consented that letters of administration of said goods and chattels with said will annexed of said deceased should be granted unto  the said John Rodon jointly with the said Howard Fetherstonhaugh saving and so forth Dated the 30th day of December 1853 M Keatinge AJ Hawkins  D Registrars

On the 22nd February 1854 Admon [with will annexed] of the goods chattels and credits of Thomas James Fetherstonhaugh late of Bracklin in the County of Westmeath Esquire deceased was granted to Howard Fetherstonhaugh Esquire one of the natural and lawful children and as such one of the residuary legatees named in the said will having been first sworn duly to administer William Chapman Esquire the nephew and Richard Fetherstonhaugh Esquire the executors and Universal Legatees In trust having conomuted ? the private and execution of the said will and also letters of Admon [with the said will annexed ] of the goods of the said deceased
