In the name of God Amen The four and twentieth day of July in the year of our Lord One thousand seven hundred and six I William Fetherstone of Harburn in the county of Warwick Gent being sick and weak in body but of sound and perfect memory and understanding thanks be to Almighty God I do make confirm? Ordain and declare this my last will and testament in manner and form following Revoking and annulling by these present all and every testament and testaments will and wills by me made and declared either by words or writing And this is only to be taken for my last will and testament and none other And first I commit my soul unto the hands of Almighty God and my body to be buried in the church at Packwood in the county of Warwick And now for the settlement of my temporal estate and such chattels goods and debts as it hath pleased God to bestow upon me I do order give and bestow the same in manner and form following First I will that all such debts that I now do or shall hereafter owe in right or conscience to any person be well and truly paid by my executors and trustees hereinafter named Imprimis [first] I do give unto my loving wife the use and occupation of all my household goods during her widowhood and then I give the same unto my four daughters hereinafter named equally to be divided between them. Item I do give and devise unto my very good friends Thomas Fetherstone of Packwood in the county of Warwick Esq and Thomas Newsham of the Borough of Warwick Esq and their heirs All my messuages lands tenements and hereditaments with their appurtenances in Harbury aforesaid and Whitnash in the said county of Warwick upon special trust and confidence that the said Thomas Fetherstone and Thomas Newsham and their heirs shall and with all convenient speed after my decease make sale of all the said messuages lands tenements and hereditaments with the appurtenances or so much thereof as they shall think fit and apply so much of the said money thereby to be raised for payment of my debts as shall be sufficient to do the same and to apply the residue thereof for payment of the legacies and portions unto my children That is to say I do give unto my three eldest daughters Anne Arabella and Frances two hundred pounds apiece and to my daughter Dorothy three hundred pounds And the over plus if any shall be of the monies to be raised by such sale and sales I do give the same unto my only son Thomas Fetherstone And my will is that the interest which shall be raised by the said several sums not given to my said daughters shall be applied towards their education until their respective ages of twenty four years at which time I will the said legacies not given to them shall be paid and in case any of them shall die before that age then her or their said portion or portions shall cease and be void and until sale of my said real estate in Harburn and Whitnash my will is that the rents hereof be applied towards payment of the interest of the said debts and residue thereof towards the education of my said daughters and in case it shall so fall out by reason of my wife’s dower or otherwise that my said real estate in Harbury and Whitnash shall not be sufficient to pay my debts and the said portions to my four daughters Then my will is that the same shall be supplied and made up out of the rents of the residue of my estate which I do hereby empower my trustees and executors to apply accordingly And lastly I do constitute and appoint Edward Welshman of Lapworth Clerk and Paul Low Master of the Temple near Balshall in the said county of Warwick to be guardians of all my said children until their respective ages of one and twenty years and to be trustees of the legacies hereby given to my said daughters until the several ages of twenty four years and I do also make the said Thomas Fetherstone and Thomas Newsham executors of this my last will and testament In witness Whereof I have hereunto subscribed my name and set my seal the day and year first above written Wm Fetherstone signed sealed published declared and delivered in the presence of Jno Kitchener Jno Chesley Bernard Sheppard
