Richard Featherstonhaugh 1822 Cumberland

 This is the last will and testament of me Richard Featherstonhaugh of Alston in the parish of Alston in the county of Cumberland, innkeeper I give devise and bequeath to my oldest son Alexander Stephenson Featherstonhaugh All that my freehold estate hereditaments and premises situate at and commonly called and known by the name of Windyhall in the parish of Kirkhough and county of Northumberland To hold the same to him the said Alexander Stephenson Featherstonhaugh his heirs and assigns for ever Subject to the mortgage money and interest now charged thereon I give and bequeath to my dear wife Mary Featherstonhaugh and my daughter Maria Featherstonhaugh All my household furniture plate china and linen to be equally divided between them as their own absolute property I give devise and bequeath to my said dear wife Mary Featherstonhaugh and daughter Maria Featherstonhaugh all my freehold and leasehold hereditaments and premises situate in the parish of Alston in the county of Cumberland or elsewhere and not hereinbefore devised And also all my farming stock monies book and other debts and other my personal estate and effects whatsoever and wheresoever not hereinbefore bequeathed To hold the same to the said Mary Featherstonhaugh and Maria Featherstonhaugh their heirs executors administrators and assigns according to the several natures and tenures thereof Upon the trusts hereinafter mentioned and declared ` of and concerning the same That is to say Upon trust that they the said Mary Featherstonhaugh and Maria Featherstonhaugh and the survivor of them and the heirs executors and administrators of such survivor do and shall as soon as conveniently may be after my decease absolutely sell and dispose of all my said freehold and leasehold hereditaments and premises so devised to them to any person or persons who shall be willing to become the purchaser or purchasers thereof or of any part thereof and that either by public sale or private contract for the most money and best -------- from ----- that were as-ably he had or gotten for themselves, and also sell or dispose of call in and convert  into money such part and parts of my personal estates and effects not herein specifically bequeathed as does not at present consist of money and upon trust by and from the monies that shall arise from such sale or sales and to be got in and produced as aforesaid in the first places to pay off and discharge all my just debts funeral and other expenses And in the next place to place the remainder of such monies out at interest upon Government Real or other good security and to call in and place the same again out at interest upon the like securities as often as occasion shall require And upon interest by and out of the interest therefrom arising to pay to my son Thomas Featherstonhaugh one annuity or yearly sum five pounds for and during the term of his natural life the first yearly payment to be made at the end of twelve calender months next after my decease and to be afterwards paid by equal half yearly payments during his natural life as aforesaid But I direct that in case my  said son Thomas Featherstonhaugh shall at any time or times hereinafter assign transfer mortgage or make over the said annuity or sum of money or any part thereof to any person or persons whomsoever for his life or any shorter period that then the same shall cease and be no longer paid or payable and that his receipt or receipts alone shall be a sufficient discharge and discharges to my executrixes hereinafter named for the same, and that the same shall not be paid or payable to any other person or persons whomsoever, and upon trust to pay the remainder of such interest to my said dear wife Mary Featherstonhaugh for and during her natural life And by her applied for her own maintenance and for the maintenance of my children the said Maria Featherstonhaugh and John Featherstonhaugh in  such way and manner she may think fit, and from and after the decease of my said dear wife then I devise? That the sum of one hundred pounds, part of the said monies so devised to be placed out at interest --------------at interest the interest thereof applied in payment of the said annuity so given to my said son Thomas Featherstonhaugh in case the same shall then continue payable by virtue of this my will but in case the same annuity shall be forfeited by my said son by any of the means hereinbefore mentioned then I direct the interest of the said one hundred pounds to be applied for the benefit and support of my said daughter Maria and son John Featherstonhaugh during the life of my said son Thomas Featherstonhaugh and from and after the death of my said son Thomas Featherstonhaugh Then I direct the said one hundred pounds to be paid to his eldest child lawfully begotten who shall be then living when he or she shall attain the age of twenty one years and the interest thereof in the mean time from the death of my said son to be applied for his or her maintenance until of age but in case my said son shall leave no children lawfully begotten him surviving , Then I direct the said one hundred pounds at his decease to be equally divided amongst my three children Maria Joseph and John Featherstonhaugh in the same manner as their own legacies hereinafter by me given to them are directed to be paid and payable and from and after the decease of my said dear wife as before mentioned as to the remainder of the said money so to be placed out at interest I direct the same to be equally divided amongst my three children the said Maria Joseph and John Featherstonhaugh the share of such of them as shall then have attained twenty one years of age to be then paid to them and the share of those under age to be paid to them when they shall arrive at age and the interest thereof to be applied for their maintenance in the meantime and in case of the death of any of my said three children under age without leaving lawful issue him her or them surviving Then I direct the share or shares of him her or them so dying to be equally devided amongst the survivors or survivor of my said three children but in case he she or them so dying shall leave lawful issue then I direct the parents share to be equally divided amongst such issue when they shall respectively attain twenty one years of age and the interest thereof to be applied for their maintenance in the meantime And I direct and declare that the receipt and receipts of my said dear wife Mary Featherstonhaugh and daughter Maria Featherstonhaugh or the survivor of them or the heir executors or administrators of such survivor shall be good and sufficient discharge and good and sufficient discharges for the purchase or purchasers of all or any part of my said hereditaments and premises hereinbefore written to be sold for his her or their purchase money or any part thereof and that after such receipt or receipts of such purchase or purchases shall not be obligated or liable to --- to the application of such purchase money or any part thereof not answerable or accountable for any loss misapplication or nonapplication thereof or any part thereof And I appoint my said dear wife Mary Featherstonhaugh and daughter Maria Featherstonhaugh joint executrix of this my will and I request my friend Joseph Bowman of Alston aforesaid to assist them in the settling of my several affairs and that he be recompensed for any trouble or loss of time he may sustain thereby In witness whereof I have to this my last will and testament contained in this and the two preceding sheets of paper set my hand and seal that is to say to the two preceding sheets set my hand and seal this third and last sheet set my hand and seal this twenty sixth day of January in the year of our Lord one thousand eight hundred and twenty two Richd Featherstonhaugh
