DURHAM PROBATE RECORDS 1817.
This is the last Will and Testament of me Henry Featherstonhaugh of Barns in the parish of knarsdale in the County of Northumberland yeoman I give and bequeath unto my dear Wife Margaret Featherstonhaugh for and during the term of her natural life All my Household furniture and Implements of Household Beds and Bedding and I direct the same at her decease to be equally divided by my Executors amongst such of my Children / exclusive of my Son William/ as shall be then living.I Give devise and bequeath unto my friends--- Richard Featherstonhaugh of Alston in the County of Cumberland Innkeeper and John Bell of Cornwood Row in the parish of Haltwhistle and County of Northumberland farmer and my Brother in Law William Bell of Harlee House in the said parish of Haltwhistle yeoman All that my freehold Estate situate at, and called by the name of Luzley High Field in the parish of Knarsdale aforesaid lately purchased by me of James Vickers and now tenanted by the said James Vickers And all other the freehold premises lately purchased by me of the said James Vickers To Hold the same with the appurtenances unto and to the use of the said Richard Featherstonhaugh John Bell and William Bell their Heirs and assigns for ever Subject nevertheless to and chargeable with the payment of one third part of the rents and profits of the said Estate and premises as the same shall come in and be received to my said dear Wife Margaret Featherstonhaugh for and during the term of her natural life but which I order and direct shall be in bar and in lieu of any dower or thirds or other Interest which she can or may be entitled to or claim of or in the same premises by the common Law or otherwise--.----------------------------------------------------------
And Subject as aforesaid I do hereby direct my said Trustees and their Heirs to stand seized----possessed of and interested in my aforesaid Estate and premises Upon the Trusts hereinafter mentioned/ that is to say / Upon Trust to pay and apply the remainder of the rents and profits thereof during the Minority of my son William Featherstonhaugh in such way and manner as they shall think fit towards the Maintenance and Education of all and every my Children including the Child or Children that my said Wife is now ensient or pregnant with And upon my said Son William Featherstonhaugh attaining the Age of Twenty-one years then I direct my said Trustees and their heirs by mortgage of the same Estate and premises or out of the rents and profits thereof or by both of the same ways and means to raise and levy the sum of One Hundred pounds and to pay and apply the same sum as hereinafter mentioned And subject to the said payments to my said Wife for her life and to the said Sum of One Hundred pounds so directed to be raised as aforesaid and in Case my said Son William Featherstonhaugh shall live to attain the Age of Twenty-one Years Then I direct my said Trustees and their Heirs to stand seized possessed of and interestes in the said Estate and premises In Trust for my said Son William Featherstonhaugh his Heirs and Assigns for ever And in Case of the death of my said Son –William Featherstonhaugh before he attains his age of Twenty-one years Then I direct my said Trustees and their Heirs to stand seized possessed of and interestes in the said Estate and premises / subject to the said payments to my said Wife for her life / In Trust for all and every other my Children who shall live to attain the Age of Twenty-one years / including the Child or Children my said Wife is now ensient or pregnant with / their Hiers and Assigns for ever as Tenants in Common and the rents and profits thereof during their respective Minorities to be paid and applied towards their Maintenance and Education as my said Trustees shall think fit I Give devise and bequeath unto the said Richard Featherstonhaugh John Bell and William Bell all my Money due to me upon Mortgages Bonds or Notes and all my Stock or Cattle and all other my personal Estate and Effects Goods and Chattels whatsoever and wheresoever not hereinbefore by me given Upon Trust with all convenient speed after my decease to convert the same personal Estate and Effects Goods and Chattels into Money and thereout in the first place to pay off and discharge all my debts and funeral and other Expences and the Expences of proving this my Will and then to place the remainder of such Money out at Interest upon Government Real or other good Security and thereout to pay the Sum of Ten pounds a year to my said dear Wife Margaret Featherstonhaugh for and during the time she shall continue my Widow by two equal half yearly payments on the twelfth day of May and the twenty-second Day of November in every year the first half yearly payment thereof to begin and be made on such of the said days as shall first happen next after my decease / which yearly sum I do hereby give to my said Wife in addition to the Bequest hereinbefore given to her / and Upon Trust to pay and apply the remainder of such Interest / and also the said ten pounds a year so given to my said Wife from and after her decease or second marriage / and all other the yearly Income arising from my said personal Estate and Effects for and towards the maintenance and Education of all and every my Children / including the Child or Children my said Wife is now pregnant with / in such manner as my said Trustees shall think best till my said Son William shall attain his Age of Twenty-one Years And from and after his attaining that age then to apply such yearly Interest and Income arising from my said personal Estate and Effects and also the Interest of the said Sum of One Hundred pounds so directed to be raised out of my said freehold Estate / subject to the payment of the said Ten pounds a year to my said Wife during her --- Widowhood / to the Maintenance and Education of all and every my Children then living / exclusive of my said Son William / till they shall respectively attain their Ages of Twenty-one years And I direct that in Case my said Wife shall continue my Widow when the eldest of such –Children / exclusive of my said Son William / shall attain the age of Twenty-one years That my said Trustees shall then place out at Interest the Sum of Two-Hundred pounds in order to enable them out of the Interest thereof to pay the said Sum of Ten pounds a Year to my said Wife during her Widowhood as aforesaid And I also further will and direct that they shall pay and apply the remainder of the principal arising from my said personal Estate and Effects and also the said Sum of One Hundred pounds in casa my said Wife shall not then be my Widow as the Case may be equally to and amongst all and every my Children Ann Margaret Sarah Elizabeth Henry and John Featherstonhaugh and the Child or Children which my said Wife is now pregnant equally share and share alike the share or shares of such of them as shall at the death or second Marriage of my said Wife have attained the Age of Twenty-one Years to be then paid and the share or shares of such of them as shall not then have attained that Age to be paid to them as they shall respectively attain such Age and the Interest thereof during their Minority to be applied at my said Trustees shall think fit towards their respective Maintenance and Education And that the share and shares of all and every my Children Ann Margaret Sarah Elizabeth Henry and John Featherstonhaugh and the Child or Children with which my said wife is now pregnant of and in all my Aforsaid personal Estate and Effects shall be considered as vested Interests in such of the same Children respectively who being a Son or Sons shall live to attain the Age of Twenty-one Years or die under that Age leaving lawful Issue and in such of the same Children who being daughters shall live to attainthe age of twenty-one Years or day or respective Days of Marriage which shall first happen And that in Case any of the said Children shall die before his her or their share or shares shall become so vested that the share or shares of him her or them so dying shall go equally to and amongst the Survivor and Survivors of them my said Children and my said Son William Featherstonhaugh [ in case he shall be then living] share and share alike I give devise and bequeath unto my said Trustees Richard Featherstonhaugh John Bell and William Bell their Heirs and Assigns All such real Estates as are now vested in me by way of Mortgage in order to enable them with the greater ease and convenience to recover receive and get in the Money secured by such Mortgages for the purposes of this my Will And I do hereby direct that the receipt and receipts of my said Trustees or the Survivors or Survivor of them shall be a sufficient discharge and sufficient discharges whenever the same may be wanted or given for the purposes of this my Will And I do hereby direct and declare that my said Trustees shall not be answerable or accountable one for the others or other of them or for the Acts or deeds of the others or other of them but each of them for his own Acts only and that they and each of them shall and may retain to and reimburse themselves and himself all such reasonable Costs Charges and Expences as they or any of them shall or may be put unto in and about the execution of this my Will and also a reasonable recompense for their and each of their time and trouble in and about the execution of the Trusts hereby in them reposed And that they nor any of them shall be answerable or accountable for any loss that my Estate and Effects without their or some or one of their wilful Default or Neglect And I do hereby Appoint The Said Richard Featherstonhaugh John Bell and William Bell joint Executors of this my last Will and Testament and do hereby revoke all my former Wills In Witness whereof I have to this my last Will and Testament contains in this and the preceding three sheets of paper set my Hand and Seal this twentieth day of February in the Year of our Lord One thousand eight Hundred and sixteen.
